Terms of service

These terms are an agreement between you (and the company you sign up for) and PermitPulseDaily, which operates permitpulsedaily.com. By using the site or subscribing, you agree to them. PermitPulseDaily is a business-to-business service. Questions: [email protected].

Subscriptions and free trial

Plans are $99, $199 or $449 per month (members who joined at earlier prices keep their price), as shown when you sign up, plus any applicable tax. Plans renew automatically every month and your card is charged each month until you cancel. New members get a 14-day free trial; a card is required. If you don't cancel before the trial ends, your card will be charged the monthly price of your plan on the day the trial ends and every month after that. One trial per person or company. During the trial, access is limited to 1 city and 1 trade, up to 100 spreadsheet rows a day, and no API access. We may change prices with at least 30 days' email notice before your next renewal.

Cancelling and refunds

You can cancel anytime online from Manage billing in your account, or by emailing [email protected]. Cancelling stops future charges; your access continues until the end of the period you've paid for. We don't refund partial months unless the law requires it.

Acceptable use

Your subscription is for internal use by you and your company. You agree not to: resell, republish or share PermitPulseDaily data or exports; share your sign-in with other companies; scrape or bulk-download the site by automated means; use the data to harass anyone; or use it in violation of law, including anti-spam (CAN-SPAM), telemarketing (TCPA and Do Not Call) and privacy laws. You may not use PermitPulseDaily data to make decisions about anyone's eligibility for credit, insurance, employment or housing. We may suspend or close accounts that break these rules.

Data sources and accuracy

Permit data comes from public records published by government agencies under their open data terms; see Data sources. Those agencies don't endorse PermitPulseDaily. The data may contain errors, delays or missing details, and we can't guarantee it's complete, accurate or current. Check important details with the issuing agency before relying on them.

No warranties

PermitPulseDaily is provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the service will be uninterrupted or error-free, or that it will produce any particular business results.

Limitation of liability

To the extent the law allows, PermitPulseDaily and its owner won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities. Our total liability for any claim relating to PermitPulseDaily is limited to the amount you paid us in the 3 months before the claim arose.

Indemnity

You agree to defend and hold harmless PermitPulseDaily and its owner from claims, losses and costs (including reasonable legal fees) that arise from your use of the data or the service in violation of these terms or the law, including any marketing calls or emails you send.

Ending the service

You can stop using PermitPulseDaily anytime. We may suspend or end your access if you break these terms, don't pay, or if we discontinue the service. If we discontinue the service for reasons other than your breach, we'll refund any prepaid, unused portion.

Disputes, arbitration and class action waiver

Please contact us first; most issues can be solved by email. If we can't resolve a dispute within 30 days, you and PermitPulseDaily agree that it will be decided by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules (or its Consumer Arbitration Rules if they apply), rather than in court. The arbitration may be held by video or in Honolulu, Hawaii. Either side may instead bring an individual claim in small claims court, or ask a court to stop infringement or misuse of intellectual property or data. You and PermitPulseDaily each give up the right to a jury trial and to take part in a class action or class arbitration. You can opt out of this arbitration section by emailing [email protected] within 30 days of first signing up.

Governing law

These terms are governed by the laws of the State of Hawaii and applicable U.S. federal law, without regard to conflict-of-law rules. Any court case allowed under these terms will be brought in the state or federal courts located in Honolulu, Hawaii.

Other terms

If part of these terms can't be enforced, the rest still applies. Not enforcing a term isn't a waiver. You may not transfer your account without our consent. These terms, together with the Privacy policy, are the whole agreement between us about PermitPulseDaily.

Changes

We may update these terms. We'll change the date above, and significant changes will be emailed to members at least 14 days before they take effect. Continuing to use PermitPulseDaily after that means you accept the new terms.
